Modification of Terms
Watchfinder reserves the right, in its sole discretion, to change, modify, add or remove these Terms, or portions of them, at any time. Please check these Terms periodically for changes. Your continued access and/or use of the Site following the posting of any modifications to these Terms shall constitute your acceptance of and agreement to any new or amended Terms.
Description of Services and Merchandises
Watchfinder provides users of the Site with access to the sale of luxury items (primarily, but not limited to, watches and jewellery) (the “Services”). You are solely responsible for obtaining access to the Site, and for any third-party fees and/or equipment necessary to access the Site (such as a computer and Internet access).
The description of the merchandise can be found on the Site. We do our best effort to ensure that the goods that are supplied to you are identical to those on the Site, although there may be minor variations to the description and/or specification of the goods due to the changes made by the manufacturers. Pictures and photographs of the goods on the site are for illustrative purposes only, and may not exactly match the goods.
We do not guarantee the accuracy of the colour or design of the products on our website. We have made efforts to ensure the colour and design of our products are displayed as accurately as possible on our website.
All purchases through our website are subject to product availability. We may, in our sole discretion, limit or cancel the quantities offered on our website or limit the sales of our products or services to any person, household, geographic region or jurisdiction. Prices for our products are subject to change, without notice. Unless otherwise indicated, prices displayed on our website are quoted in Canadian dollars and include applicable taxes.
If you create an Account, you are solely responsible for any activity that occurs through your Account. In order for us to provide you the best possible service, you agree to provide us with complete, accurate, and updated information for your Account at all times. If any information is incorrect or outdated, it can lead to errors or delays, for which we will not be responsible.
You should not share your Account information. You may never use another person’s Account or registration information for the Services without permission. Similarly, no one should be able to use your Account without permission. You are solely responsible for keeping your Account and Account password secure. To protect the confidentiality of your account, Watchfinder advises that you log out from your account and close all browsers at the end of each session. You should never publish, distribute, or post login information for your Account. You agree to notify Watchfinder immediately of any unauthorized use, or breach of the security, of your account or log-in credentials.
If you are expecting an item to be delivered to you, whether through an order you made online or a transaction that occurred in-person at one of our retail locations, the item will be delivered to the specified delivery address provided by you on the order form only after payment has been received.
Shipping is free. The item will be delivered overnight via FedEx Express Shipping Services. We ship within Canada and to the United States. Because minor delays or setbacks may occur, the shipping date and time specified by us is only an estimate and is not guaranteed. We will not be held responsible for any delay caused by our suppliers.
If for any reason at all (not due to the company’s fault) you do not accept delivery of any of the goods in accordance with this paragraph then we may charge you an additional fee to cover any reasonable additional direct costs incurred by us as a result (including additional insurance, delivery, storage or similar charges).
Inspection of Goods
Upon delivery the Customer is encouraged to inspect the goods carefully. If the goods are damaged or missing, please contact us, and refrain from using the goods. Once the goods have been received by the Customer, any damage incurred is the responsibility of the Customer. The Customer will be liable for any loss or damage inflicted on the merchandise from the time of the delivery unless such loss or damage is caused by our negligence. The Company will not pay the Customer's cost for any return of goods.
Price and Payment
All prices stated on the Site include applicable taxes and shipping charges. The Customer will pay the specified price upon placing the order either online through our secure server, or in-person at one of our retail locations. We accept all major credit cards including Visa, MasterCard, American Express, and Discover Card. Credit card payments are subject to authorization by the credit card issuer. If authorization is declined, we will not be held liable for non-delivery of any ordered goods. We also accept personal cheques, which must clear before the item is shipped. Western Union money order, cashier's check, and bank-to-bank wire transfers are also acceptable.
Liability and Warranty
We will not be liable for any damage caused to the goods by the Customer once they have been delivered.
All information and material provided by this Site are provided on a given basis with no guarantee. We do not guarantee that the information is complete nor accurate nor current and updated.
Under no circumstances will the Company or its employees, agents or subcontractors be liable to the Customer for any business interruption, loss of use, loss of data, loss of profits, contracts, goodwill or anticipated savings. Nothing in these Terms of Service excludes or limits our liability for death or personal injury resulting from our negligence or any breach of the statutory implied terms as to title of goods or for fraud or any other liability which by law we are not permitted to limit or exclude.
Our total liability (and that of our employees, agents or subcontractors) to you in connection with any physical damage caused to your property through the negligence of us (or our employees, agents and subcontractors) will not exceed the price of the goods and services to which the claim relates.
Provision of Services
We reserve the right, in our sole discretion, to refuse orders, including without limitation, orders that appear to be placed by distributors or resellers. If we believe that you have made a false or fraudulent order, we will be entitled to cancel the order and inform the relevant authorities.
Restrictions on Use of Materials
This Site is owned and operated by Watchfinder. No material from Watchfinder.ca may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that you may download one copy of the materials on any single computer for your personal, non-commercial home use only, provided you keep intact all copyright and other proprietary notices. Modification of the materials or use of the materials for any other purpose is a violation of the Watchfinder trademarks, copyrights, patents, and other proprietary rights. For purposes of these terms, the use of any such material on any other Web site or networked computer environment is prohibited. All trademarks, service marks, and trade names are proprietary to Watchfinder.
Unless otherwise specified, the materials in the site are presented solely for the purpose of selling our products in Canada and the United States. Watchfinder makes no representation that materials in the site are appropriate or available for use in other locations. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
These terms are effective until terminated by either party. You may terminate these terms at any time by destroying all materials obtained from Watchfinder.ca and all related documentation and all copies and installations thereof, whether made under the terms of these terms or otherwise. These terms will terminate immediately without notice from Watchfinder if in our sole discretion you fail to comply with any term or provision of these terms. Upon termination, you must destroy all materials obtained from this Site and all copies thereof, whether made under these Terms or otherwise.
At Watchfinder we offer a vast selection of top brand names and high quality goods. We proudly stand behind the authenticity of our goods and we do our utmost best to verify the authenticity of each item we carry. Occasionally, these goods were not obtained directly from the manufacturers but rather have been purchased from owners and resellers. In this regard, Watchfinder expressly disclaims any indication that it is an authorized dealer or agent of any of the designers whose goods are offered on this site.
All other trademarks, service marks, product names, company names and logos appearing on Watchfinder are the property of their respective owners. In addition, Watchfinder disclaims any implied representation or warranty with regard to this site or its contents, including the merchandise offered on this site.
